Terms and Conditions of Business
An individual or business requesting work from The Calm Curator will be referred to as ‘the client’.

Booking the task

Initial discovery phone call of approx 30 minutes, will take place for all clients.

An initial consultation will then be arranged which can be a Zoom call at no charge or an in person visit at £30.00. Images and or video will need to be supplied if you can’t commit to either a Zoom call or in person consultation.

When a package has been discussed the details will be sent by email to the client for confirmation.

The client will indicate acceptance by reply and these Terms and Conditions will form part of the contract.

Timescales and deadlines will be agreed prior to commencement of the task.
The task
-
The client must give us access to any and all relevant information, materials, properties and any other matters which we need to provide the Services.

We need to be given the following information:
-
Parking availability and restrictions
-
Type of property and access i.e. if it is a 2nd floor flat is there a lift
-
Are their any pets
-
Who will be at the property during the visit.

When more than 3 hrs is spent with the client in one sitting, reasonable breaks will be taken, if it is over lunchtime, a lunch break will be taken.
Fees and Payments
-
The fees for the Services are set out in the quotation and are on a time and materials basis.

Milage will be charged at 0.45p and will be incurred for any visit.

If it takes longer than 30 minutes to travel to your destination, a travel fee will be chargeable to the client, £10 for every additional 15 minutes.

In addition to the Fees, we can recover from you a) reasonable incidental expenses including, but not limited to, travelling expenses, hotel costs, subsistence and any associated expenses, b) the cost of services provided by third parties and required by us for the performance of the Services, and c) the cost of any materials required for the provision of the Services.

You must pay us for any additional services provided by us that are not specified in the quotation in accordance with our then current, applicable hourly rate in effect at the time of performance or such other rate as may be agreed between us.

Invoices are payable within 7 days of the invoice date. Invoices will be sent once the work has been completed.

Payment options: Bank transfer.

Payments must be made in UK pounds sterling from a UK bank account or by credit or debit card via PayPal.

Should any payment fail, the client will be liable for all related charges.

If payment is not made in 7 days The Calm Curator will be entitled to suspend all work for the client, or to terminate the relevant contract, and any other contracts with the client.

The Calm Curator reserves the right to impose an interest charge equal to 10% above the Bank of England base rate per annum in respect of any invoice which is outstanding for more than 30 days from initial presentation.

Termination

The client may terminate the contract giving The Calm Curator a minimum of 10 days written notice

We can terminate the provision of the Services immediately if you:
-
commit a material breach of your obligations under these Terms and Conditions; or
-
fail to make pay any amount due under the Contract on the due date for payment; or
-
are or become or, in our reasonable opinion, are about to become, the subject of a bankruptcy order or take advantage of any other statutory provision for the relief of insolvent debtor; or
-
enter into a voluntary arrangement under Part 1 of the Insolvency Act 1986, or any other scheme or arrangement is made with its creditors; or
-
convene any meeting of your creditors, enter into voluntary or compulsory liquidation, have a receiver, manager, administrator or administrative receiver appointed in respect of your assets or undertakings or any part of them, any documents are filed with the court for the appointment of an administrator in respect of you, notice of intention to appoint an administrator is given by you or any of your directors or by a qualifying floating charge holder (as defined in para. 14 of Schedule B1 of the Insolvency Act 1986), a resolution is passed or petition presented to any court for your winding up or for the granting of an administration order in respect of you, or any proceedings are commenced relating to your insolvency or possible insolvency.

Cancellation rates

If dates are cancelled or postponed within 10 days of the delivery date 25% of the fees and expenses will be required, within 7 days of the delivery date 50% of the fees and expenses will be required, within 2 days of the delivery date 100% of the fees and expenses will be required. If dates are rearranged within 28 days of the original date no cancellation fee will normally be charged.
Liability

The Calm Curator will not be held responsible for any loss, damage, theft etc of data, documents, effects or any items relating to tasks during transit to and from my premises.

In no event shall The Calm Curator be liable for any indirect punitive, special or incidental damage (including loss of business, revenue, profits, use, data or other economic advantage) however it arises.

Clients have sole responsibility for adequate protection and back up of data and/or equipment used and will not make a claim against The Calm Curator for lost data, inaccurate instruction, work delays resulting from a contract.

The Calm Curator retains the right to reject work that they feel is illegal, immoral or objectionable.

Confidentiality

All work undertaken by The Calm Curator is treated in confidence.

Data will be kept in accordance with the requirements of the GDPR and will be kept secure and password protected. Data will only be kept for as long as is necessary to process the data.

No details regarding clients or information relating to work carried out will be disclosed or passed to a third party without prior consent unless we are legally obliged to do so.
